2.- Acceptance
This website and the services provided (hereinafter the Service) is available to any user and it is subject to the following terms and conditions: these Terms of Use and Sale, our Privacy Policy, and our Cookie Policy.
When you use the Service you accept our terms and conditions. With this, you agree not to use this site for illegal purposes.
The language in which the contract will be perfected will be in Spanish, regardless of whether documents in other languages are displayed on the website or the user of the website decides to use automatic translation tools. In case of conflict in the wording shown in one language or another, the Spanish version will always prevail.
3.- Description and Use of the Service
3.1.- Description
Save The Med is a foundation dedicated to the regeneration of the Mediterranean Sea so that it recovers its rich biodiversity and prospers in harmony with environmentally conscious and proactive local populations.
It is an organization with extensive experience in regional projects related to marine conservation and they collaborate with a wide network of local organizations to take care of the marine environment.
3.2.- Service
In addition to being informed about our initiatives and latest news, you can purchase products from our foundation and make donations.
The donation process in the Service will be as follows:

Within the website, the user who voluntarily wants to make donations must fill out the corresponding form with their identifying information: Name, email, address, city, country, postal code, telephone number.

Likewise, you must indicate the amount of the donation, in euros, and select the payment method. You can also indicate if your donation is one-time or if it will be repeated monthly.

Before making the payment, if made through the website, the user must accept the terms and conditions of the website. And, subsequently, the donation certificate will be sent to you via the email provided in the form.

In any case, the Service will not receive any commission from the donation received, the entire amount of which, except for associated bank charges, will be used to finance projects for the care of the marine environment and the Mediterranean basin.
The product purchasing process will be as follows:

Select the products you wish to purchase from those offered by Save The Med on its website.

Once selected, you must click on the cart symbol, and the product will be added to your shopping cart. If you wish, you can continue adding more products.

Once the product selection is completed, a summary will appear identifying the selected item(s).

To continue with the purchasing process, you must identify yourself with your user account details or complete the registration form if you are not yet a registered user.

Next you must complete the form with the shipping address information. When you include your shipping address, prices and delivery times will be calculated and the amount will be added to your pending purchase.

The registered user can access their Customer Area to view, print or download the invoices corresponding to the purchases made.

Finally you must choose the payment system.

Once the payment process is complete, Save The Med will send you an email detailing the details of your order. If you do not receive this email within 24 hours, please contact us. If you notice any errors in the data entered in your order, you can correct them through the “Contact Us” section or by writing to us at info@savethemed.org

From this moment, Save The Med will proceed to deliver the product to the indicated address within the established time.
4.- External links
The Service may direct you to other websites through links.
However, the Service has no control over those sites or their content, subject to their own terms and conditions. Therefore, the Service is not responsible for the quality, veracity, or accuracy of the information contained therein.
5.- Age
Regarding registration in our Service, the purchasing or donation process, you declare that you are of legal age and that you have the necessary legal capacity to be bound by this agreement and use the site in accordance with its terms and conditions, which you fully understand and acknowledge.
You acknowledge that you have the proper authority and representation to enter into contracts on behalf of a company when you do so.
You declare that all information you provide to access the Service, before and during use, is true, complete and accurate.
6.- Intellectual and industrial property
The content and information on the Service (including data, text, sound or image), as well as the hardware or software used to provide such content and information, are the property of Save The Med or have the corresponding authorizations for their use.
Furthermore, modification, reproduction, duplication, copying, distribution, sale, resale and other forms of exploitation for commercial or equivalent purposes of the Service are prohibited.
Any other use of the content of the Service requires our prior written consent.
7.- Content
You can contribute to the Service by sending us messages to our email address, through the contact form, or by sending messages through the platform's messaging system (hereinafter "Content").
We may use your Content in different ways, such as: displaying it on the website, reformatting it, translating it into other languages, editing it for clarity, correcting errors, promoting it or distributing it.
Therefore, by sending us Content you grant Save The Med a worldwide, non-exclusive, free license, until the content is withdrawn, transferable and sublicensable on that Content.
That means that the content is still yours, but Save The Med, thanks to that license to use, can: a) use, reproduce, modify, adapt, translate, distribute and publish the Content, create derivative works from it, display and perform it throughout the world, by any known means and for any lawful purpose; and b) use the name you submit in connection with that Content.
However, Save The Med reserves the right not to publish content or information that is false or contrary to the rights of third parties.
8.- Product delivery and availability
We deliver to: Balearic Islands and the Iberian Peninsula. No shipments will be made to the Canary Islands or Ceuta and Melilla.
The delivery date at your home may change depending on the availability of the chosen product, the warehouse of origin, the shipping area or other specific circumstances of each order. It may also change due to extraordinary incidents with the carrier and due to difficulties in the delivery of the merchandise.
In any case, during the purchase process you will be informed of the expected delivery time based on the data you include for delivery.
On the other hand, and unless otherwise indicated, remember that deliveries are made by an external supplier, so they could be delivered any day of the week including Saturdays, Sundays and holidays depending on the supplier and its delivery area.
On the other hand, if the purchased product is not available, you will be informed of this through the website, indicating the most likely date of availability. Based on this information, the user can choose whether to wait, decide to choose another product or cancel the order.
9.- Price and taxes
The prices of the products offered on Save The Med are indicated in euros (€) and include the value added tax (VAT) applicable to these services in Spain but not the shipping costs that will be calculated later based on the delivery address that you indicate.
The price of the products will be the one stipulated at all times on the website, except in the case of obvious error. Although Save The Med tries to ensure that all prices listed on the website are correct, errors may occur.
If an error is discovered in the price of the products that the client has selected, Save The Med will inform the client of this fact as soon as possible.
10.- Shipping costs
A fixed amount for shipping costs must be added to the prices indicated for each product. This amount will be indicated in each case during the purchasing process and can always be consulted in advance at the bottom of the website.
11.- Payment
Online payment for purchased products must be made in full in advance and through:

Credit or debit card and Google Pay or Apple Pay, through secure payment gateways, charging the amount at the time of purchasing the products.
In this sense, Save The Med informs credit and debit card holders that transactions in the online store are carried out through a secure payment gateway, using TSL technology to guarantee security in the transmission of data.
12.- Right of withdrawal, returns and refunds
12.1.- Right of withdrawal
As a consumer, you will have a period of fourteen (14) calendar days to exercise your right of withdrawal. However, to do this, the product purchased must not have been unsealed after delivery nor have it been used.
To exercise the right of withdrawal you must notify us at our postal address or by email at info@savethemed.org.
In any case, you must indicate to us your express decision to withdraw from the contract. You must return the order along with the delivery note and, where applicable, the invoice issued by Save The Med.
Although it is not mandatory, you can use the model withdrawal form that we provide in the Addendum at the end of these terms and conditions.
If you exercise your right of withdrawal, we will return all payments received within a maximum of 14 calendar days from the date on which you inform us of your decision. In any case, the direct costs of returning the goods must be assumed by you.
We will make this refund using the same payment method that you used for the initial transaction, unless you expressly indicate otherwise.
We may withhold the refund until we have received the goods.
Without prejudice to the above, the right of withdrawal will not be applicable with respect to the supply of sealed goods that are not suitable to be returned for reasons of health protection or hygiene and that have been unsealed after delivery, according to article 103, letter e) of Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users.
If you do not act as a consumer, total or partial withdrawal of your order is not possible. In case of dispute, contact us at info@savethemed.org.
With respect to donations, as it is an unconditional donation intended for the general purposes of Save The Med, making it does not entail the delivery of any product or service, nor is there any right of withdrawal, as established by Law 7/ 1996, on the Regulation of Retail Trade and Law 3/2014, of March 27, which modifies the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws, approved by the Royal Legislative Decree 1/2007, November 16.
The regime of guarantees on products or services, regulated in Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users, is also not applicable.
Finally, since it is a donation and it is made voluntarily by the donor, no type of reimbursement is contemplated, whether partial or total. If in doubt, contact us at
12.2.- Returns and exchanges
If the product arrives damaged, in poor condition or is incorrect, if you are a consumer, Save The Med allows you to exchange it for a new one or a voucher for an equivalent amount within a period of fifteen (15) calendar days, counting from the date of receipt, and at no additional cost. To do this, the product must be in its original packaging (if present) and must not have been opened.
The return of the purchased items must be carefully packaged and include the delivery note or invoice delivered. For returns, contact us at info@savethemed.org.
If it cannot be done by ordinary mail, once the request has been confirmed, the carrier will contact you to specify the day and time of collection, without additional charges.
On the other hand, in the first fifteen (15) calendar days from the delivery of the order, and in the indicated shipping territories, you can also exchange it for one of a higher or lower amount, adding or returning the difference as the case may be. For example, a change in size or color.
Shipping and collection costs for exchanges of damaged or defective products will be borne by Save The Med.

12.3.- Refunds
You can cancel your order at any time and without any cost as long as you notify us before the order is being prepared. Otherwise, you must wait to receive the order to exercise the right of withdrawal, if possible.
Once the good has been received, Save The Med will verify that it is in good condition and will proceed to send the required product if an exchange has been requested, to send the correct product instead of the defective one or, in case of withdrawal, will proceed to refund the amount in the same payment method used in the purchase.
The refund period will be up to 14 calendar days from when Save The Med has been informed of the user's decision to withdraw, for example through the corresponding attached document and through proof of the return made.
In any case, we may withhold the refund until we have received the goods.
13.- Validity of offers
The products offered in the Service, and their prices, will be available for purchase while they are in the catalog viewed through the website.
In any case, Save The Med reserves the right to make any modifications to the Service that it deems appropriate, and may update functions of the Service according to the market.
The prices that appear on the website are indicative. Save The Med reserves the right to change prices without prior notice.
We inform you that despite the updates made to the prices of the Service, they may contain errors. We will promptly correct any errors that appear, but they will not be binding on the Service.
14.- Guarantees and exclusion of liability
14.1.- Legal guarantees
As a consumer, the products are covered by a three-year legal guarantee against non-conformity under applicable legislation.
If the lack of conformity of the product appears during the first two years, it is understood that the failure already existed when the product was delivered, unless the contrary is proven or when this presumption is incompatible with the nature of the product or the nature of the lack of conformity.
If the lack of conformity appears after those first two years, you will have to prove that the defect is original so that it is covered by the legal guarantee.
You have the obligation to report possible defects and non-compliance within 2 (two) months from their detection.
In the event of a lack of conformity, we will proceed, at our expense, to reestablish the conformity of the product by repairing/replacing or reducing the price, as established by current legal provisions.
Remember that warranty assistance requires prior presentation of the purchase invoice.
In any case, all the rights that current laws guarantee you as a consumer and user are guaranteed.
14.2.- Exclusion of guarantees
Except in those cases expressly described in these terms and conditions and to the extent permitted by law, Save The Med is not responsible for damages of any nature that may be due to a lack of accuracy, completeness or timeliness, including errors and omissions of the information contained in the Service. Likewise, there is no duty or commitment to verify or monitor its contents and information.
Likewise, Save The Med does not guarantee the availability and continuity of operation of the Service. Save The Med will try to warn sufficiently in advance of any interruptions that may occur in the operation of the Service whenever possible.
Save The Med excludes, to the full extent permitted by the legal system, any liability for damages of any kind that may be due to the lack of availability or continuity of the operation of the Service. Likewise, with respect to the fraud of the utility that users could have attributed to the Service.
Likewise, Save The Med excludes any liability for damages of any kind that may be due to the use of the Service and its contents by users, clients or professionals, or that may be due to the lack of veracity, validity or authenticity of the information that users provide to others about themselves. In particular, Save The Med excludes any liability for damages of any kind that may be due to the impersonation of a third party carried out by a user in any type of communication made through the Service.
15.- Security
As indicated above, the entire purchase and sale procedure, as well as the transmission of your personal data and payment systems, is carried out on a secure page and in encrypted form through the TSL protocol.
We guarantee the security of the Service in accordance with present technological knowledge. However, the Service cannot guarantee the complete future security of the Service. In any case, we are committed to fixing and implementing the appropriate corrective measures to correct a possible security breach as soon as possible.
You agree to notify Save The Med, immediately and via email at info@savethemed.org, about any situation that could lead to the impersonation of a user.
16.- Modifications and nullity
We may update the terms and conditions of the Service in the future, as well as features and functions of the Service itself.
We will inform you about changes to the terms and conditions by placing a notice in a prominent place on our website and/or by email.
If any clause included in our terms and conditions is declared, in whole or in part, null or ineffective, it will only affect said provision or the part of it that is null or ineffective. The terms and conditions will subsist in everything else, with such provision, or the part of it that is affected, being considered not to have been established.
17.- Claims and actions derived from the contract
This Service is governed by Spanish legislation and in the event of a dispute with a consumer it submits to the Judge or Court that corresponds to the domicile of the consumer and user.
According to the applicable regulations, Save The Med informs of the existence of a European online dispute resolution platform that facilitates the extrajudicial resolution of said disputes for contracts also concluded online between consumers and users and Internet service providers. This platform can be accessed through the following website: http://ec.europa.eu/odr
If the contracting of the Service is carried out by a business, in the event of a dispute the parties submit to the courts of Palma de Mallorca and Spanish legislation.
Likewise, we inform you that Save The Med makes available to clients who request it the official model of complaint forms that can be found in the Consumer Portal of the Autonomous Community of the Balearic Islands, download at this link (Self-fillable complaint form pdf), or requested through our email at info@savethemed.org.
In order to simplify the resolution of claims through civil means and reduce costs, we do not exclude the possibility of submitting to Equity Arbitration of the Court of Arbitration of the Chambers of Commerce and Industry.
